E-2 Treaty Investors
The E-2 Investor Visa is the fastest route for foreign investors and their families to live and work in the United States. Available to citizens of countries with trade treaties with the U.S., this non-immigrant visa is based on a substantial business investment. While it does not lead to a green card, it grants residency rights as long as the business remains viable, allowing for indefinite renewals. Often referred to as the “mini green card,” the E-2 Visa provides a direct path to U.S. residency for eligible investors.

As a non-immigrant resident, if the principal applicant spends no more than 122 days in the United States, there is no need to pay tax on global income. The E-2 visa does not directly lead to a "green card," but if the investment amount is increased to meet the requirements of EB-5, the E-2 visa can be converted to EB-5 over time and apply for citizenship.
Application Requirements:
To qualify for E-2 classification as a treaty investor, an individual must meet specific criteria:
- Nationality Requirement: The individual must be from a country that has a commerce and navigation treaty with the United States.
- Investment Criteria: The investor should have already invested or be in the process of investing a significant amount of capital in a legitimate enterprise in the U.S. The goal is to generate profit, with the capital being at risk of loss if the investment fails. Additionally, the investor must demonstrate that the funds were not acquired through criminal activities.
- Operational Control: The investor must intend to enter the U.S. primarily to develop and manage the investment enterprise. This can be demonstrated by owning at least 50% of the enterprise or holding a key managerial position or other controlling stake.
