L-1A Intracompany Transferee Executive or Manager
The L-1A Visa, known as the U.S. Intracompany Transferee Executive or Manager Visa, facilitates the transfer of executives or managers within a multinational company to the United States. This program, free from numerical caps and U.S. Department of Labor approvals, sets no specific criteria for age, language proficiency, or asset source. Families can immigrate to the U.S. in 4-6 months, with the possibility for the visa holder to transition to a Green Card via the Employment-Based Immigration Priority Category EB-1C.
Application Requirements：
- The main applicant must have held an executive position at a company outside the United States for a continuous 12-month period in the past 3 years (documentation proving employment at the company can be provided).
- The overseas company where the main applicant held an executive position should have 10-20 employees or more, operate legitimately, and demonstrate the need for executive management and operation
- Before submitting the application for the U.S. company, there should be steps taken such as registering the company, opening a business account, and leasing an office. The U.S. company needs to have a relationship with the overseas company. Either as the parent company, branch, subsidiary, or affiliate (which can be further aligned through stock transfers). Additionally, there should be a genuine business need to send an executive to the U.S. for management and operation.
Application Process:
- After signing the contract, the client needs to provide personal information and company details. Please refer to the specific document collection checklist.
- Plan the future development of the company and complete the business plan.
- Develop a personalized I-129 application strategy based on the client’s situation.
- Submit the application, with the option to expedite the processing, receiving a response in 15 working days.
- The client can choose to have an in-person interview at the jurisdiction of their residence.
Upon success, please proceed to enter the United States as soon as possible.
