United States EB-5 Investor Program
The EB-5 Investment Immigration Program, established by the U.S. Congress in 1990, falls under the fifth preference category of U.S. employment-based immigration. As of the 2022 policy update, applicants are required to invest USD $800,000 in a government-approved commercial project within the United States. This investment must also lead to the creation of 10 new jobs. By fulfilling these criteria, the primary applicant, along with their spouse and unmarried children under the age of 21, become eligible to apply for U.S. green cards, offering a pathway to permanent residency and the benefits of living in the United States.
Application Requirements：
- Invest USD $800,000 in a qualified project.
- Create at least 10 employment positions.
- Provide a legitimate and legal source of investment funds.
- Undergo a medical examination, and have no criminal records.
Application Process:
- Develop funding source plan, gather documents, prepare materials, and have the applicant complete the investment.
- Submit the I-526E application and receive the I-526E submission receipt.
- Receive the successful approval of I-526E from the U.S. Immigration Office.
- Proceed with either the NVC process at a U.S. consulate overseas or the I-485 approval process within the U.S. immigration office.
- Obtain a 2-year temporary U.S. Green Card.
- Submit the I-829 application to remove conditions and apply for a permanent Green Card three months before the expiration of the temporary Green Card.
